Mediation is a meeting between the parties involved in a dispute with a neutral person who controls the process and helps the parties explore possible settlement options. Mediation creates a relaxed and safe environment for problem solving because it's voluntary and confidential. Mediation allows the parties to form their own settlements and agreements for a win/win outcome. The mediator DOES NOT make any decisions for the parties.
 
Mediation is an excellent alternative to costly litigation for cases involving employment disputes, union grievances and EEO complaints, debt collection, construction disputes, personal injury, malpractice, real estate, property damage and customer complaints. Mediation is required for contested divorce issues in Utah.

The true spirit of resolving conflict is acknowledging the other side's point of view. You don't have to agree with the other side, but understanding that their point of view is as important to them as yours is to you, eases tensions and brings down barriers that might prevent settlement.   Sometimes, just listening to the other side's point of view opens the doors of communication.  A good mediator will help the parties express their views and guide them in the communication process.  There are no guarantees that mediation will result in settlement of all disputed issues. The outcome depends entirely on the participant's desire to reach an agreement, their willingness to compromise and the mediator's skills. The mediator must have excellent negotiation and problem solving skills and know how to help the parties work on difficult sticking points.  Master Mediators have achieved the highest level of experience by conducting more than 300 hours of mediation. Selecting the right mediator could mean the difference between settlement and litigation.
